These are some factors that can be in play, though they are rarely all present at the same time: The seriousness of the charges, the statutory or legal “constraints” (like mandatory time limits) the type of case, experience of the prosecutor or judge, and yes, even the time of the year. After a full case investigation is complete, then it is easier to know when a case will be resolved and how (by a plea agreement or trial, for instance). Frequently, there will be at least some control that the client and attorney can exert in the case. Time is sometimes a “friend” in criminal defense.

Yes. These cases require a judge to find that you are, in essence, ready to drive again. These cases are started by filing a petition in court (essentially suing the Missouri Department of Revenue), and they have the right to up to 30 days before their legal response. Then, the case is set for a hearing, where myself, yourself, and the Department of Revenue attorney will be present, not to mention the judge.

Possibly. If the convictions are not much more than two years old, and probably have a good shot at getting those “set aside” by an attorney such as Cameron. This is basically a “do over”, where he can try to get the points removed. The ability to do this varies by the court where you were convicted, because there will be a judge, prosecutor, and potentially others who may not want to see this happen. Nevertheless, Cameron is very happy to make the attempt to do now what was not done when the case was new.
